These Terms of Service ("Terms") govern your use of the website getsiteready.com.au and the purchase of Safe Work Method Statement (SWMS) documents from GSR Australia (ABN registered) ("we", "us", "our"). By purchasing documents from us, you agree to these Terms.

1. Products and Services

We sell professionally structured SWMS document templates in editable Microsoft Word (.docx) format. Documents are pre-filled with the business details you provide during checkout and are structured around Australian WHS/OHS legislation requirements.

2. Templates, Not Legal Advice

Our documents are templates only. They are not legal advice and do not guarantee compliance with any legislation. You are responsible for:

• Reviewing each document before use
• Adapting documents to your specific site conditions, hazards, and work activities
• Ensuring documents meet the legislative requirements in your state or territory (see our state-by-state breakdown)
• Keeping documents up to date as legislation, standards, or site conditions change
• Ensuring all workers review and sign off on the SWMS before commencing work

We strongly recommend seeking independent professional advice if you are unsure about your WHS/OHS obligations.

3. State and Territory Legislation

Our documents are structured around the national model WHS framework. Please note:

• Victoria operates under the Occupational Health and Safety Act 2004 (Vic) and OHS Regulations 2017 (Reg 327), not the national WHS framework. Victorian users should update legislative references in the documents.
• Western Australia adopted the WHS Act 2020 (WA), not the WHS Act 2011. WA users should review legislative references.
• South Australia and Tasmania adopted the model WHS framework in 2012, not 2011. Content requirements are identical.

All documents are delivered in editable Word format so you can update legislative references for your state. See our FAQ for full details.

4. Pricing and Payment

• All prices are in Australian Dollars (AUD).
• Payment is processed securely by Stripe. Your card details never touch our servers.
• Promotional discounts are applied at checkout and may be withdrawn at any time.

5. Delivery

• Documents are generated and available for download immediately after payment.
• A download link is also sent to the email address you provide at checkout.
• Download links expire after 72 hours. If your link expires, contact us and we will issue a new one.

6. Refunds

Because our products are digital goods delivered instantly, we do not offer refunds for change of mind once documents have been downloaded.

We will provide a refund or replacement if:

• You received the wrong documents
• Documents could not be downloaded due to a technical fault on our end
• Documents are substantially different from what was described

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). If our documents fail to meet a consumer guarantee, you are entitled to the remedies available under the Australian Consumer Law.

7. Licence to Use

When you purchase documents from us, we grant you a non-exclusive, perpetual licence to:

• Use, edit, and adapt the documents for your own business purposes
• Use the documents across multiple sites within your business
• Print and distribute copies to workers and principal contractors as needed for WHS compliance

You may not:

• Resell, redistribute, or sublicence the documents (whether modified or unmodified)
• Share documents with other businesses for their independent use
• Upload documents to template-sharing or document-selling platforms

8. Intellectual Property

All document templates, website content, and branding remain the intellectual property of GSR Australia. The licence in Section 7 does not transfer ownership of any intellectual property.

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any loss, damage, injury, or penalty arising from your use of, or reliance on, our documents.
• Our documents are templates that require your review and adaptation. We do not warrant that they will be accepted by any particular principal contractor, regulator, or inspector without modification.
• Our total liability to you for any claim is limited to the amount you paid for the documents.

This limitation does not apply to the extent that it would contravene the Australian Consumer Law or any other law that cannot be excluded by agreement.

10. Indemnity

You agree to indemnify us against any claim, loss, or expense arising from your use of the documents, including any failure to adapt documents to your specific site conditions or comply with applicable legislation.

11. Website Use

• You must not use our website for any unlawful purpose or in any way that could damage, disable, or impair it.
• You must not attempt to gain unauthorised access to any part of our systems.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of the website after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
